Understanding the decision and its effect
An administrative dispute starts with the decision, the application or the action being challenged. We review what the authority decided, which reasons it gave and how the decision affects your rights. The date and method of notification can determine the time available to respond.
Send the complete document, including the appeal instructions, attachments and proof of receipt. If the issue is a failure to act, include the original application, filing confirmation and subsequent correspondence.
Matters involving public authorities
We advise individuals and businesses on disputes concerning registration, permits, licences, municipal decisions, residence applications and other administrative matters. The work may involve a refusal, a restriction, a suspension or a failure to make a required decision.
Different subjects can have special rules. Tax matters, administrative-offence penalties and immigration decisions need their own procedural assessment. We identify the applicable procedure before preparing a complaint or court claim.
Administrative complaints and access to the file
We check whether an administrative complaint must first be made, which body should hear it and what must accompany it. We can prepare the complaint, organise the supporting evidence, request access to relevant case materials and represent the client during its consideration.
The legal argument should address both the decision’s reasoning and how the authority established the facts. Missing evidence, an incorrect legal basis or a failure to consider material circumstances can require different responses.
Court proceedings against an authority
Where a court claim is appropriate, we assess the relief that should be requested. Depending on the circumstances, this may concern annulment of an act, issuance of a decision or performance of a required action. We prepare the claim, evidence and procedural applications and represent the client at hearings.
Setting aside a refusal does not always mean the requested permit or registration is granted immediately. A decision may require the authority to reconsider the matter. We explain the effect of the judgment and review the authority’s subsequent actions.
Deadlines and urgent protection
Administrative challenges can be subject to short deadlines and special rules. We calculate the relevant period from the documents and the applicable law. Where immediate consequences need attention, we assess whether suspension or another interim measure should be requested and whether an exception applies.
The effect of an appeal on an existing decision must be checked for the particular type of case. If a restriction, enforcement measure or immigration issue is urgent, identify that when you first contact us.
Documents for an initial review
- The full decision, refusal, notice or relevant application
- Confirmation of filing and evidence of when the decision was received
- Supporting documents originally submitted to the authority
- Previous complaints, replies and court documents
- The outcome sought and any immediate consequences or approaching dates
Starting the work
We begin by reviewing the decision, deadline and procedural position. Before further work, we agree the proposed complaint or court representation and the professional fee. Official charges, translations and expert work are listed separately. If a decision has already been appealed, send the previous submissions so that the next step can be assessed accurately.
Legal sources
The relevant legislation is available through Matsne, Georgia’s official legislative publication.
