Preparing your position before court
A dispute often begins with an unpaid obligation, a broken agreement or a disagreement over property. We examine the documents, identify the parties responsible and discuss what a court can be asked to order. The first assessment considers the evidence, applicable deadlines, likely costs and whether a negotiated resolution is realistic.
If proceedings have already started, send the claim, court notices and the date each document was received. A response needs to address the other party’s case and present the documents supporting your own position.
Claims and disputes we handle
Our civil litigation work includes contractual and commercial disputes, payment claims, property disagreements, damages and disputes between business partners. We represent claimants and defendants. Family, inheritance and employment matters receive attention to the separate rules and personal circumstances involved.
We prepare claims, responses, counterclaims where appropriate, evidence submissions and procedural applications. During hearings, we present the client’s position and address the opposing party’s evidence and arguments.
Interim measures and evidence
Sometimes a case needs attention before the final hearing because property may be transferred or enforcement could become difficult. We assess whether the circumstances justify asking for an attachment, a restriction or another interim measure. The application must explain why the particular protection is needed; the court decides whether to grant it.
We also review which documents are missing, whether evidence should be preserved and whether an expert opinion would help establish the disputed facts. Keep original documents and complete message records, including attachments and dates.
Settlement, hearings and appeals
A settlement may resolve payment, performance, costs and the practical steps needed to end a dispute. We negotiate terms and prepare an agreement that records those obligations clearly. If the matter proceeds, we prepare for the hearings and keep the client informed of the decisions and next steps.
After a judgment, we assess the grounds and deadline for an appeal or cassation, including the applicable admissibility requirements. Representation at a later stage and work on enforcement are agreed separately where they are outside the original engagement.
Clients living outside Georgia
Much of the preparation can be coordinated remotely. We explain the power of attorney, translation and authentication arrangements needed for representation. If a court requires personal attendance or particular evidence, we discuss that requirement in advance. Foreign judgments and arbitration clauses require a separate assessment of jurisdiction and enforceability.
Documents for an initial review
- The agreement and any amendments, invoices or payment records
- A short chronology and the result you want to achieve
- Important emails, notices and other correspondence
- Court documents and evidence of their receipt, if a case has begun
- Details of the parties, property involved and any approaching deadline
Fees and the next step
Send the main documents with a short explanation of the dispute. We will confirm the proposed work and professional fees before starting. Court charges, translations, expert work and enforcement expenses are identified separately, so you can assess the cost of proceeding.
