Construction & Developer Disputes in Georgia

Legal support for buyers, property owners and businesses dealing with delayed completion, defects, disputed payments or an agreement with a developer or contractor.

When a property project does not follow the agreement

An apartment may be overdue, the delivered condition may differ from the specification, or a developer may ask the buyer to sign a new agreement. We start with the signed documents and the actual position of the project. The legal response depends on the obligations agreed, the breach and the evidence available.

We assist with projects in Tbilisi, Batumi and elsewhere in Georgia. Buyers living abroad can arrange an initial document review remotely and discuss representation by power of attorney.

Delayed completion and handover

We review the completion date, permitted extensions, notice requirements and the description of the property to be delivered. A delay in construction, handover, registration and permission to use a building can raise different questions, so the documents must identify which obligation is outstanding.

Depending on the circumstances, the work can involve demanding performance, reviewing contractual penalties or damages, negotiating a revised deadline or assessing termination and repayment. Any proposed compensation must be checked against the agreement, the applicable law and proof of the loss.

Defects and differences from the specification

For quality or condition disputes, we compare the contract, plans and agreed specification with the work delivered. Photographs, inspection records and correspondence about defects help establish when the problem was identified and how the other party responded.

We can prepare a written claim, review a proposed rectification agreement and coordinate with a suitably qualified technical expert where needed. Before signing a handover document or release, have its effect on outstanding complaints checked. Record the defects and retain the relevant evidence.

Refunds, termination and additional demands

A demand for repayment needs a clear legal and factual basis. We assess whether a notice or an opportunity to remedy is required, what has already been paid and what should happen to any registered rights. We also review requests for additional payment and amendments that change the original price, area or timetable.

For contractors and commercial clients, we advise on payment certificates, acceptance of work, variations and disputed performance. The documents should show what was authorised and how the amount claimed was calculated.

Negotiations, court proceedings and property protection

We prepare demands, negotiate settlements and represent clients in court where necessary. If there is evidence of a risk to enforcement, we assess whether an interim measure concerning identified property or another appropriate form of protection should be requested.

Public Registry records, encumbrances and the identity of the contracting company matter. Where a project involves insolvency, competing rights or several companies, we examine those issues before recommending a claim. A dispute about a municipal permit may require a separate administrative challenge.

Documents for a review

  • Purchase, preliminary purchase or construction agreement and amendments
  • Payment records, the agreed specification and project plans
  • Public Registry extract and known information about the project
  • Notices, correspondence, inspection records and photographs
  • Any proposed handover, settlement or replacement agreement

Starting with the main documents

Tell us which project is involved, what was promised, what remains outstanding and what outcome you want. We agree the proposed work and fees after the initial review. Technical inspections, expert opinions, official charges and translations are identified separately from the legal fee.
