Assessing the debt and the debtor
Before pursuing a payment, we check who owes the money, when it became due and which documents establish the claim. A contract with a company does not automatically make its director or shareholder personally responsible. Identifying the correct debtor is an early part of the work.
We review the principal amount, payments already received, any claimed interest or penalties and relevant limitation issues. Available registry information and the debtor’s known assets help assess whether pursuing the claim is commercially worthwhile.
Demand letters and payment negotiations
A demand letter should set out the obligation, the amount claimed and the requested response. We prepare the letter and the supporting calculation, then handle correspondence or negotiations as agreed with the client.
Where payment by instalments is proposed, we review the dates, acknowledgments, security and consequences of non-payment. A settlement should record what remains payable and how performance will be checked. We also advise debtors who dispute a demand or need to respond to proceedings.
Court claims and summary proceedings
For a documented monetary claim that has fallen due, we consider whether the National Bureau of Enforcement’s summary procedure is available. Its requirements, the contract’s dispute provisions and the effect of an objection need to be assessed before applying.
Where a debt is contested or court proceedings are appropriate, we prepare the claim and evidence. The work may include reviewing delivery records, acceptance documents, account statements and correspondence about performance. If there is an arbitration clause, we examine its effect on where the dispute must be heard.
Protecting the claim while the dispute is pending
If there is evidence that enforcement may become difficult, we assess a request for interim protection. The application must connect the requested measure with the claim and the circumstances. Information about specific property or proposed transfers can matter at this stage.
Enforcement after a decision
We assist with obtaining the necessary enforcement document, preparing an application and representing the creditor during enforcement proceedings. The work includes reviewing notices, payments and available information about assets, and addressing procedural problems as they arise.
The debtor’s financial position remains relevant after a successful claim. If insolvency proceedings or competing creditors affect recovery, those issues require a separate assessment. A foreign judgment or arbitral award may also require recognition before enforcement in Georgia.
What to send us
- The contract, loan document or other basis of the claim
- Invoices, delivery or acceptance records and payment evidence
- The debtor’s name, identification number and known contact details
- Correspondence acknowledging or disputing the debt
- Any judgment, enforcement document or notice already received
Agreeing the work and fees
Tell us the amount outstanding, how long it has been overdue and whether the debtor has responded. We will propose the next steps and fees after reviewing the main documents. Official charges, translations and enforcement expenses are set out separately from the professional fee.
